How We Use Your Personal Information

We use your personal information to help us efficiently operate the ORGANO website, to contact you in connection with your transactions and other activities on the ORGANO website, to forward messages to you from other users, to correct problems, collect service fees, gather demographic information, analyze data to improve your experience, enforce our Independent Distribution Partner agreement, resolve user disputes, protect against fraud or criminal activity, and inform you of offers, updates or services that might be of interest. These types of communications are known as “Operational Communications.” In some cases, Operational Communications may also contain commercial messages, such as banner ads and special offers. It is our policy not to sell or rent to any to third parties, your personal information for any purpose without your expressed consent. We may however, gather personal demographic data which may be disclosed in a manner that is not personally identifiable, for the purpose third party marketing analysis. This would not include your name, financial account numbers, email, or passwords.

We also use personal information to send you newsletters, information, offers and other promotional materials for ORGANO’s or third parties’ goods or services. ORGANO will cooperate with law enforcement inquiries, as well as other third parties in the interest of enforcing laws, preventing criminal activity, protecting rights (including intellectual property), and protecting you and our ORGANO community from harmful or criminal acts. Therefore, if we receive a verified request by government officials or other law enforcement agencies regarding an alleged illegal activity or investigation, you authorize us to disclose any of your personal information or history without a subpoena. In an effort to respect your privacy however, we will not otherwise disclose your personal information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, unless we believe that such information is necessary to prevent imminent physical harm or financial loss, or to report suspected illegal activity. You also authorize us to disclose your personal and account information under confidentiality agreement, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity.

Our Security Precautions

All of ORGANO’s website user information is stored on secure servers within the United States and protected by applicable Federal laws. ORGANO has security measures in place to protect against the loss, misuse and alteration of the information under our control, and that which is exchanged on ORGANO website. Our secure server software (SSL) is the industry high standard and among the best software available today for secure commerce transactions. We encrypt all of your personal and financial information as it travels over the Internet and we store your financial information on our servers in encrypted form.

How you may use the Information of other Users. (For Independent Distribution Partners only)

ORGANO grants its independent Independent Distribution Partners limited access to other Independent Distribution Partners’ email, ID, and shipping information, in order to allow interaction among everyone within the ORGANO community. Through the acceptance of Terms of Use, you agree that you have authority to use other users’ personal information that you obtain through the ORGANO site, through related communication, or any ORGANO-facilitated transaction, only for using services offered through ORGANO and communications that are not unsolicited commercial messages, or for any other purpose that a user expressly agrees to. Users must have an opportunity to have you remove any information you have collected about them. In addition, under no circumstances, you can disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to communicate with you regarding ORGANO related matters. Note that law enforcement personnel, and other rights holders are given different rights with respect to information they access.

ORGANO and its service providers do not tolerate “spam”. Therefore, you DO NOT have any authority or permission whatsoever to add any reference to “ORGANO”, or to otherwise insinuate that any electronic message you communicate to third parties has any affiliation whatsoever with the Company. Regardless of whom it is you are communicating with — be it a purchaser, fellow Independent Distribution Partner, or even the Company itself — AND, regardless where the message originates from — be it from another Independent Distribution Partner, your business organization, or even the Company itself — ABSOLUTELY NO MESSAGES SENT BY to you or your e-mail address should include any reference, or insinuation of approbation of the communication by the Company.

The Company has a ZERO TOLERANCE policy regarding any act which violates the above Policy. Be forewarned, if the above provision is not observed, then ORGANO will take appropriate legal action.

Children

We do not knowingly collect, use, or disclose information from children under 16. Anyone under 16 years of age is considered a child and is not eligible to utilize our services, and we ask that those under the age of 16, do not submit any personal, private, or financial information to us. If you are a child, you may use ORGANO’s site only in conjunction with a parent or legal guardian consent.

If we learn that we have collected the personal information of a child under 16, we will take steps to delete the information as soon as possible. Please immediately email [email protected] if you become aware that a child under 16 has provided us with personal information.

Your Rights

We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date.

You have the right under applicable law to access, correct, or delete the personal information that we collect. You are also entitled to object to or restrict, at any time, the further processing of your personal information. You have the right to receive your personal information in a structured and standard format. If your request is more complicated, it may take a little longer to come back to you but we will come back to you within two months of your request. There is no charge for most requests, but if you ask us to provide a significant about of data for example we may ask you to pay a reasonable admin fee. We may also ask you to verify your identity before we provide any information to you.
You may alter or update the personal, financial, or demographic information that you have given us by manually making the modifications in the sections of the ORGANO website in which you originally submitted that information.

These changes and deletions will not change or delete emails or information that we may have already forwarded to other users or credit card companies or any other third parties, all as provided above in this Privacy Policy.

Upon your request, we will deactivate your account, contact information, billing information, shipping information, and financial information from our active databases. To make this request, please email [email protected] . It may be necessary for some of the personal information that you have requested to remove, to be retained by ORGANO for the purpose of collecting any fees owed, diagnosing problems, assisting with any legal investigations, resolving disputes, preventing criminal activity, or enforcing our User Agreement. Therefore, you should not expect that all of your information will be completely removed from our files or databases in response to your requests. However, such personal information will only be available to selected ORGANO personal, and will no longer be accessible to other users or the public.

How Long We Keep Your Information

We keep your data only for as long as we need it. How long we need data depends on what we are using it for, whether that is to provide services to you, for our own legitimate interests (described above) or so that we can comply with the law.

We will actively review the information we hold and when there is no longer an Independent Distribution Partner, customer, legal or business need for us to hold it, we will either delete it securely or in some cases anonymize it.

How to Manage Marketing Messages You Receive

We may send you marketing communications by email if you have indicated that you are happy to receive such emails or if you have transacted with us and you have not told us that you no longer wish to receive marketing emails. You can update your preferences at any time. You can also opt out of receiving marketing emails by clicking on the unsubscribe link which we include in all our marketing emails.

Our marketing communications include information about our new and existing products and/or services, special offers we think you might like and other products or programs which we think might be useful to you.

Please note that if you tell us that you do not wish to receive marketing emails, you will still receive service emails which are necessary for example to confirm your purchases or to update you on the status of your orders. This is so that we can perform the contract we have with you.
